General terms and conditions

General Terms and Conditions of miWedding
Status: 15.11.2025

miWedding is an online portal primarily focused on weddings. The platform is designed to support (future) brides, grooms and other users with wedding-related inspiration, planning tools and content. By registering with miWedding (hereinafter referred to as the "Operator"), you agree to the terms of use set out here. You declare your agreement by taking note of the general terms and conditions of use during the registration process and agreeing to them by placing a tick in the "I accept the terms and conditions" box. If you do not agree, you must unfortunately refrain from registering with miWedding. miWedding provides services within the scope of this online service exclusively on the basis of these terms of use.

Our terms of use listed below can be changed by the Operator at any time without stating reasons. Of course, every person using miWedding will be informed of the changed conditions by e-mail two weeks before the new or changed terms of use come into effect. If you do not object within these two weeks after receipt of the e-mail, the new or amended terms of use will be deemed to have been accepted.

§ 1 Validity

  1. The following General Terms of Use (hereinafter also referred to as "GTC") apply to the relationship between the Operator and the user. Any deviating terms and conditions of the user that conflict with these General Terms of Use shall not apply.
  2. Within the framework of the user relationship between the Operator and the user, the GTC shall also apply if no further express reference is made to the validity of the GTC when using further services of the Operator.

§ 2 Registration and deregistration

  1. miWedding consists of a freely accessible area and an area with extended functionalities for registered users (members) that can only be accessed via registration. Information in the freely accessible area is available to every internet user, there is no obligation to register here.
  2. Anyone who has reached the age of 16 may become a member of miWedding. Persons under the age of 16 may only join miWedding with the express written permission of a parent or guardian. The Operator is entitled to check the personal details, in particular the age of the user, by means of suitable official documents.
  3. In order to be able to use the members' area of miWedding with its diverse and, compared to the free area, greatly expanded functionalities and information possibilities, the user must register with miWedding before participating and truthfully provide the data requested in the registration process. This also applies to photos of their own person.
  4. Each member of miWedding is obliged to immediately modify any changes that may occur over time to the information provided during registration.
  5. Membership of miWedding begins as soon as the information requested in the registration process has been fully and truthfully completed and submitted to miWedding. There is no entitlement to registration.
  6. Users are responsible for maintaining the confidentiality of the assigned password. Each user is responsible for all activities that take place under his or her password. Any misuse of the password by third parties must be reported to miWedding immediately by e-mail (info@miwedding.us).
  7. The user can have himself/herself deleted from miWedding's database at any time without giving any reason by sending an email to info@miwedding.us with the subject "Deletion of my account". With this deregistration, the entire data record stored under the user's profile is completely deleted. The user relationship ends with this.

§ 3 Description of the scope of services provided by miWedding

miWedding currently provides users in particular with information, inspiration and digital content related to weddings. This may include editorial content, example weddings, planning tips and other online features. There is no entitlement to the provision of specific functionalities; the Operator may change, reduce or expand the type and scope of the services at any time.

A) Community (potential future functionality)

  1. If the Operator introduces a community area in the future, such a community site may enable users (e.g. engaged couples, wedding guests and wedding vendors) to contact and communicate with each other.
  2. Users may then be able to use the platform to make friends and acquaintances and to exchange information and experiences about weddings, wedding products and services and related topics.
  3. In this case, the user would have the possibility to create a virtual profile by registering with miWedding and thus become a member of the miWedding community. All members could use their profile to contact other members, view shared information and get to know each other. Other members could search for the member on the basis of this profile, get in touch with him or her and get to know him or her better. Members could post photos or videos and share them with other users. Wedding professionals and other experts could have extended possibilities to present and view their profile, their services and other individual information.
  4. Every member could invite friends and acquaintances to become members of the miWedding community.
  5. On miWedding, members could be given the opportunity to ask questions to other members and to answer questions from other members, to give and view tips and opinions on products and services, and to write entire reviews on products or services.
  6. As far as users place further links to miWedding on external internet sites, these may be followed by the Operator and checked for their content. If it is found that these external websites contain illegal or immoral material of any kind, the links in question will be deleted by the Operator.
  7. In all these activities, the user always undertakes to respect good morals and manners. Faking someone else's identity and the use of insulting, derogatory or racist remarks are also prohibited on miWedding and may result in civil or criminal prosecution.

Currently, miWedding does not provide such a community functionality. Users are not entitled to the introduction, expansion or continued provision of a community feature.

B) Price comparison - new and second-hand market (potential future functionality)

  1. If miWedding introduces a "Price comparison" section in the future, miWedding may offer both a price comparison of new products and/or services (e.g. wedding dresses, decorations, locations, photographers) and the possibility for its members to offer used products in a second-hand market for the products on the website in the "Price comparison" section.
  2. All product prices published in the new product section would be prices for new devices or services (i.e. no second-hand goods, trade fair and exhibition devices, B-goods or similar). All prices quoted would be inclusive of the current statutory value added tax (VAT). These prices would always represent the price communicated to miWedding. For technical reasons, delays in selecting, forwarding and entering prices into the miWedding database cannot be excluded. We make every effort to ensure that the database entries are up to date, but we cannot guarantee this or accept any liability for the accuracy of the information without exception. In this respect, the prices shown on miWedding would be estimated prices and indications which must be left to the customer's verification with the retailer or service provider of his choice. If you notice any incorrect or misleading prices or other information, please inform us at info@miwedding.us, giving details of the retailer or service provider, the date and the complaint, so that we can correct the information if necessary.
  3. In the second-hand market area, registered users could place classified ads and offer their second-hand products or search for second-hand products. By placing such a classified ad you would accept the following conditions: The placement of the advertisements would be subject to these terms and conditions. Special attention is drawn to the regulations concerning the responsibility of the user and the admissible or inadmissible contents as described in § 6.

Liability: The classified ads on miWedding would originate from users. We do not guarantee the accuracy of the advertisements or of user communications, nor the quality, safety or legality of the material offered. miWedding would grant its private customers free access to the service of searching and posting classified advertisements with their own content in the database, in accordance with these general terms and conditions. miWedding would not be an intermediary, not a buyer or seller, and not an agent of the buyer or seller of the items or services stored in the database.

Currently, miWedding does not provide any price comparison or second-hand market functionality. Users are not entitled to the introduction, expansion or continued provision of such functionalities.

C) General and other services and benefits

  1. miWedding reserves the right to reduce or extend the service or the scope of services.
  2. miWedding offers the services of its platform mainly for private purposes. Commercial use is only intended within the framework of the functionalities provided by miWedding, in particular for wedding vendors and other professions related to weddings (e.g. photographers, caterers, wedding planners, locations, DJs, etc.).
  3. miWedding, however, reserves the right to decide which persons and groups present themselves here and reserves the right to delete these persons or organisations if the use does not take place within the intended functionalities.

§ 4 Prices

  1. Registration with miWedding and the use of the services provided by miWedding is free of charge.
  2. However, miWedding reserves the right to charge for the provision of certain premium services in the future. However, the areas of miWedding that are accessible with the free membership are not affected by this.
  3. In addition, the Operator reserves the right to place appropriate advertising.

§5 Liability of the operator

  1. The Operator is not liable for the accuracy and content of the information provided solely by the users themselves in the registration or profile data of the users. The Operator assumes no liability for the possible misuse of this information.
  2. The Operator is not liable for the content of the publications of the users; this applies in particular to cases in which the content posted by users violates the intellectual property (trademark rights, copyright, etc.) or the personal rights of third parties. This exclusion of liability applies equally to the content of websites linked by users of miWedding without the knowledge of the Operator. As soon as miWedding becomes aware of any infringements of the law on the linked external pages, such links will be removed immediately.
  3. The Operator endeavours to ensure the proper operation of miWedding at all times. However, the Operator does not guarantee uninterrupted usability or accessibility of miWedding. It is also not liable for transmission delays or failures due to technical reasons. For example, technical faults or necessary maintenance work can lead to a temporary interruption of the miWedding service.
  4. The pages linked by miWedding were checked for any legal violations at the time of linking. Illegal content on the linked pages was not apparent at the time of linking. However, miWedding has no influence on the content of the linked external pages. It is also not possible for miWedding to continuously monitor the content of the linked external pages and it is also not reasonable without concrete indications of a legal violation. As soon as miWedding becomes aware of any legal infringements on the linked external pages, such links will be removed immediately.
  5. The Operator is not liable for the unauthorised acquisition of personal user data by third parties (e.g. through unauthorised access to the database by "hackers"). The Operator is also not liable for misuse of data and information from third party sites which the users themselves have made accessible to these third parties.
  6. The Operator is not liable for economic, physical or immaterial damage resulting from the use of the miWedding site, unless the damage is demonstrably due to intent or gross negligence on the part of the Operator or its employees.
  7. The Operator will regularly, but does not enter into any such obligation, check the content of texts, photos and graphics for compliance with statutory and legal regulations and, if necessary, delete them partially or completely.
  8. The Operator is entitled at any time, without giving reasons and to the exclusion of any claims for damages by the user, to discontinue the services of miWedding in whole or in part with immediate effect and to delete all stored user data.
  9. If there is only a suspicion of a breach of the terms of use, miWedding will not be liable for any failure to take action.
  10. If a user culpably violates these terms of use, he/she indemnifies miWedding against all resulting damages, including the costs of legal defence in the amount of the legally applicable fees.

§6 Responsibility of the user

  1. The user is solely responsible for the content of his registration and thus for the information he provides about himself. He assures not to violate any laws or rights of third parties through his behaviour and content uploaded by him (texts, images, etc.), in particular to respect the general personal rights and intellectual property rights of third parties.
  2. The user may not set up profiles on miWedding or Internet sites that are used to improperly read, store, edit, modify, forward or otherwise misuse information.
  3. The disclosure and exchange of passwords, codes and serial numbers of any kind are not permitted on the platform.
  4. Furthermore, the user undertakes that he/she will not use the miWedding platform and the third party data entrusted to him/her for the purposes of commercial advertising or advertising for political parties and/or candidates.
  5. The user guarantees that the personal data provided to miWedding (including photos of himself/herself) are true and describe the user personally.
  6. Furthermore, the user assures that his or her use of miWedding is exclusively for private and not for commercial purposes. The only exception is the commercial use of the miWedding platform by wedding-related professionals (such as wedding planners, photographers, locations, etc.) for the presentation of their own services and for the provision of information on content appropriate to the subject and target group of miWedding.
  7. The user may only use the miWedding service for the intended purpose of exchanging information and establishing mutually desired private contacts.
  8. In order to comply with the statutory provisions, in particular the secrecy of correspondence and telecommunications, the user must treat e-mails and other messages confidentially and may therefore only make them accessible to third parties with the express prior consent of the sender. This also applies to names, photos, telephone and fax numbers, address data, e-mail addresses and/or URLs (Internet addresses). Any breach of confidentiality, in particular any misuse of such data through manual or automated reading, storage, processing, modification, deletion, etc. will be legally prosecuted.
  9. In addition, the user may not intercept or attempt to intercept e-mails or other messages for other users. The user may send e-mails and comparable messages to members solely for the purpose of private communication, not to advertise or offer goods or services to other members. In particular, the user may not send or organise chain letters, pyramid schemes, competitions, lotteries, betting games snowball systems or multi-level marketing.
  10. Under no circumstances may the user, during his activities on the pages of miWedding, violate the laws in force or use the miWedding service in a way that negatively affects the availability of the offers to other users of miWedding. Without prejudice to the possible criminal liability of the user, the following content in particular is prohibited:
  • Content that violates human dignity is not permitted. This applies in particular to the portrayal of people who are dying or who are or have been subjected to severe physical or mental suffering. The consent of these persons is also irrelevant.
  • Content that depicts children or young people in unnaturally gendered postures is also not permitted. This also applies to sexist, pornographic and/or violent depictions, which deal with the sexual abuse of children or young people or sexual acts of humans with animals. Virtual depictions are also not permitted.
  • Also inadmissible is content that is listed in Parts B and D of the List pursuant to Section 18 of the Protection of Minors Act or that is wholly or substantially identical in content to a work included in this List.
  • Marks of unconstitutional organisations within the meaning of section 86a of the Criminal Code, the content of which is directed against the free democratic basic order or the idea of international understanding, shall not be permitted. This shall also apply to propaganda material within the meaning of section 86 of the Criminal Code, the content of which is directed against the free democratic basic order or the idea of international understanding.
  • Content that incites hatred against sections of the population or against a national, racial, religious or ethnic group, incites violence or arbitrary action against them or attacks their human dignity is not permitted. This also applies to insults of parts of the population or insulting, maliciously disparaging or defaming a pre-designated group.
  • Content that glorifies war or depicts the acts referred to in section 6 (1) and section 7 (1) of the International Criminal Code committed under National Socialist rule in a way that is likely to disturb public peace, or denies or trivialises such acts, shall be inadmissible.
  • Also inadmissible is content that could serve as an instruction to commit an unlawful act mentioned in section 126 (1) of the Criminal Code.

Furthermore, all content that depicts cruel and otherwise inhuman acts of violence against human beings in a way that glorifies or trivialises such acts of violence or depicts the cruelty or inhumanity of the act in a way that violates human dignity is not permitted. This also applies to virtual depictions.

  1. Furthermore, the dissemination of defamatory, offensive or otherwise unlawful material, harassment or threats and the violation of the personal rights of other users or other third parties is abusive.
  2. Finally, the user is prohibited from placing links on the miWedding platform to Internet sites with illegal content.
  3. The Operator is entitled to block and, if necessary, delete contributions if there is reasonable suspicion that legal provisions or these terms of use have been violated.

§7 Legal consequences in the event of a breach of these GTCs

  1. In the event that one or more users violate one or more of the provisions of these GTC, in particular one or more of the provisions of §6, the Operator reserves the right to exclude the user from the service with immediate effect without stating reasons and excluding the user's right to claim damages, and to completely delete the user's account including all of its data. In such cases, the Operator also expressly reserves the right to initiate civil and/or criminal proceedings (in particular the assertion of claims for damages and/or the filing of criminal charges).
  2. If a user violates one or more provisions of §6, the user is obligated to pay to the Operator a contractual penalty to be determined by the Operator at its reasonable discretion and to be reviewed by the competent court upon first demand in the event of a dispute. Furthermore, in such a case, the user is obliged, immediately after being requested to do so by the Operator, to submit a cease-and-desist declaration, which is subject to a contractual penalty and which is customary according to legal standards.
  3. The user undertakes, insofar as he/she is of age, to indemnify the Operator against any action, damage, loss or claim which may arise as a result of the misuse of a miWedding service by the user and the breach of these general terms and conditions. To the extent that the user is of legal age, he/she undertakes in particular to indemnify the Operator from any liability and from all obligations, expenses and claims arising from damages due to defamation, slander, insult, infringement of personal rights, failure to provide services to other users, infringement of intangible property (trademarks, copyrights, etc.) or other rights. In these cases, this indemnification obligation also includes the costs of the necessary legal defence (e.g. lawyers' fees) required to defend against such claims.
  4. The Operator has the right to apply §7.2 and §7.3 also to users who are not yet of age, but who have the necessary capacity of understanding and culpability.

§8 Electronic attacks by hackers, crawlers, etc.

  1. Electronic attacks of any kind on the platform / database / network of miWedding or on individual users are strictly prohibited. Any electronic attack will lead to the immediate exclusion of the user and will be prosecuted under civil and criminal law. Electronic attacks are considered in particular, without this list being exhaustive:
  • the use of computer programmes for the automatic reading of data such as crawlers (a.k.a. spiders or robots, bot for short).
  • the intentional use and/or distribution of viruses, worms, Trojan horses
  • Brute Force Attacks
  • Spamming (especially mass spamming)
  • Hacking attempts, i.e. attempts to overcome, circumvent, or otherwise override or damage miWedding's security barriers.
  • Use of links, programs or other methods that can or are intended to harm individual users, groups of users, the platform, the database or the miWedding platform.
  1. In the event of a culpable infringement of the prohibition of electronic attacks in §8.1, the user undertakes, insofar as he is of age, to pay to the Operator a lump-sum contractual penalty of at least EUR 6,000.00 (in words: six thousand euros) on first demand, to be determined by the Operator at its reasonable discretion. In the event of a dispute, the contractual penalty shall be reviewed by the competent regional court.
  2. In the event of a violation of the prohibition of electronic attacks in §8 (1), the user further undertakes, insofar as he/she is of age, to submit a cease-and-desist declaration, which is customary according to legal standards and is subject to contractual penalties, immediately after being requested to do so by the Operator. This declaration must essentially contain the following obligations (depending on the individual case):
  • Cease and desist obligation: The user declares that he/she will cease and desist with immediate effect from continuing the electronic attack or undertaking a new comparable attack. The user also declares that he/she will refrain with immediate effect from passing on any data material obtained by means of the electronic attack to any third parties.
  • Affidavit: The user affirms that he has irretrievably deleted all digital data material obtained in the course of the electronic attack completely, finally and irrecoverably from all existing data carriers. Furthermore, he/she declares that he/she has completely destroyed all analogue data material (e.g. documents, records, printouts, etc.). The user shall make an affidavit confirming in a legally binding manner that deletion and destruction have taken place. The user shall sign this affidavit and send it to the Operator. The user shall inform the Operator immediately in text form and comprehensively about which third parties (names, addresses, complete contact data) have gained access to the data material obtained in the course of the attack. The user shall also inform the Operator of the third parties (names, addresses, complete contact data) to whom the data has been transmitted or made available in any other way.
  • Confidentiality: The user confirms that he/she will maintain absolute silence about all data obtained in the course of the electronic attack. Furthermore, he/she guarantees absolute silence about the cease and desist obligation and about the affidavit as well as all internal matters of miWedding that otherwise become known to the attacker. This applies in particular to communication on internet forums, in blogs or to the press, unless the disclosure of individual information is mandatory due to public law regulations vis-à-vis authorities or in order to safeguard legal claims vis-à-vis courts.
  1. §8.2 and §8.3 also apply to users who are not yet of age, but who have the necessary capacity of understanding and culpability.

§9 Involvement of third parties

The Operator is entitled to commission third parties with the provision of parts or the entire range of its services. Data protection remains unaffected by this.

§10 Preservation clause (severability clause)

Should any provision of these GTC be or become invalid or incomplete in part, the validity of the remaining clauses of the GTC shall remain unaffected. Instead of the invalid provision, the corresponding statutory provision shall apply. The same applies to any loopholes in the GTC.

§11 Jurisdiction and applicable law

As far as legally permissible, the place of jurisdiction is Munich. The law of the Federal Republic of Germany shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
